Eviction Package

I provide a service for my customers (known as tenants in this case) and I give this service to my best of ability.  My tenants get quiet enjoyment of MY properties that I have bought for them.  I get paid for my service the day it is delivered i.e. the first day the rent is due.  In most cases I get paid on or a few days after the due date but sometimes you meet a ……… smart guy.


A smart guy that thinks they can live in your property for FREE.


While YOU pay the mortgage on time (because you have to) and keep a roof over THEIR head, all they do is hide behind the law, because supposedly the law always favours the tenant, and they say explicitly or implicitly:


“take me to court!”


Well I’ve always got something to say to them:


“No worries, you’ll be out of my place within 1 week AND I’ll take your deposit so I’ll be the one in credit”


And


“I will do this WITHOUT me having to write to you, confront you or speak to you”


This usually happens with a 96% success rate.  The other 4% of the time I do go to court and I win every time.


Now can I ask you:


Have you got a tenant that is living in your property but is point blank refusing to pay the rent? Are they more than 1 day late with their rent?


Are you getting more and more stressed as the mortgage payments come out of your bank account on a timely basis but the rent comes in on an untimely basis?


Do you get annoyed when some of your surplus cash, meant to be spent on yourself, is being used to meet the monthly mortgage payment because your smart guy tenant is not paying up?

To collect rent in full and on time you have to let your tenant know that you are a HARD PERSON!  Now do not take this the wrong way.


“I am not saying that if the tenant doesn’t pay you send ‘the boys round to take the tenant for a few flying lessons out the window’.  This is illegal and put simply – A VERY STUPID THING TO DO.  The law, in this case, is definitely in the favour of the tenant and so it should be.  If the tenant doesn’t pay the rent it doesn’t mean it gives you the right to physically harm them.”


What I mean by a hard person is that as soon as your tenant is one day late with the rent you send the troops in.


This means:

  • A barrage of persuasive phone calls demanding rent and threatening eviction
  • An onslaught of debt collection letters stating full payment is required or court action will commence, CCJs will be registered and bailiffs will visit
  • Fearful official court papers being sent summoning the tenant to court to pay all rent arrears and court costs
  • Upon a successful court order being granted (which is ALWAYS the case) court bailiffs with a Police Escort will be sent in to actually evict the tenant to the nearest homeless unit.

GAME OVER.

The tenant cannot do anything but leave.  At some point in the process above, once troops have been sent in, the tenant will leave.  If you have a difficult tenant who is determined to stay then they will be escorted out by the police and court bailiffs within 12 weeks.


So who are the troops?


Well it certainly ain’t ME or YOU!


We’ve got better things to do with our time!  Do you think I would be phoning everyone of my tenants that was one day late with their payment? If I did then my job would not just be full time it would be major time!


I’ve got other things to do like buying more properties, socialising or sleeping!


I’m sure, like me, you do not want to be involved with the day-to-day hassles of collecting bad debts.


So Who Does It?


Well its simple.  The day the tenant is one day late you:


Day 1

Instruct my preferred debt collection agency.  You simply complete the agency’s online form about the debt and then they will HARASS (or should I say chase!) the tenant for 3 weeks by phone and letter.  THERE IS NO UPFRONT COST.  All you have to do is give them the tenant’s name, phone number and address.  That’s it.  No calling, writing or visiting the tenant. You don’t even have to speak to the debt collection agency!  The agency gets paid 4.5%-9% upon successful collection only.Usually the tenant pays up and you get at least 91% of the debt.  But the key thing is the tenant knows from now on not to be late.  THE FULL WEB LINK TO THIS AGENCY IS INCLUDED IN THIS PACKAGE. 
Day 14(week 2) Send tenant eviction notice If the debt collection agency are struggling then its okay, its simply time to GET LEGAL!  Send the tenant the proper section 8 notice which gives the tenant 14 days to get out.  Its easy to fill out and you have full legal rights to issue the notice as the tenant is more than 14 days late with the rent.  No Judge can contest this ground as it is legal fact.  This will either scare the tenant in to paying or they’ll get out.  You’ll have the tenant squirming back asking for part of their deposit back but you’ve incurred expenses (like 5p for the paper and 27p for the stamp!).  So you can tell your tenant that it’s just too bad – they should have paid the rent on time.THE SECTION 8 EVICTION NOTICE IS INCLUDED IN THIS PACKAGE. 
Day 21(week 3) Start court action If they haven’t left then you will have to fill out court forms and send them to the county court.  They are extremely easy to fill out.  Once received by the court they will issue summons to you and the tenant.  On or around Day 30 the tenant will receive a county court summons asking them to attend court.  At this point the tenant will usually panic, see ‘SUMMONS’ and ‘COUNTY COURT’ and get the hell out!  However, the smart arse tenant may still remain.  Then, unfortunately, you will have to attend court.ALL THE COURT FORMS ARE INCLUDED IN THIS PACKAGE. 
Day 58(week 8) Attend court In the unlikely event that you have to attend court you simply present the section 8 eviction notice, a tenancy agreement (if you have one) and get the court order for possession of the property.  You will also get a money judgement (known as a CCJ) but don’t bother chase it as you ain’t gonna get paid.This gives the tenant 14 days to leave.  They will leave before then.  But if the smart arse tenant still remains then you instruct the court bailiff.  
Day 82(week 12) Court Bailiff Visit with Police Escort Once you’ve got a court order then there is NO legal ground for a tenant’s defence.  The bailiff will enter in to the premises by either knocking on the door or picking the lock and changing the locks and will remove the tenant. If the tenant resists then the police will be called.ALL THE COURT BAILIFF FORMS ARE INCLUDED IN THIS PACKAGE.SAY GOOD BYE TO THE SMART GUY.

But Shouldn’t I Get A Solicitor?

Hell No!  Unless you like spending your cash on irrelevancies like solicitors then you should NEVER get a solicitor involved.  This is crap work for a solicitor as it is neither interesting for them nor financially rewarding for them even though it still costs YOU a lot of money.  Solicitors struggle to justify their fee.  While you chase a £500 debt and the solicitor charges you at least double that then it all becomes wholly uneconomicable.   A solicitor knows how easy the process is and they prey on your ignorance and laziness.

This is exactly what a smart arse tenant does.  They steal from a legitimate business person (being you) with no punishment from the state.  But do they get the same treatment as if they stole fromTesco? Certainly not!  Its YOU who has to take the tenant to court at your own expense.  Does the tenant face prison – No! All they get is an court order to leave the premises and a money judgement which they’ll never pay.


The concept of court makes you think of solicitors, barristers, paperwork and pledges to the oath – which all sound expensive and foreign to us all.  So in the end you abstain from going to court and let the problem become bigger and bigger or make you resort to unorthodox means for getting the tenant out.


My aim is to make non payment of rent a CRIMINAL OFFENCE.  Just like non payment of council tax, parking fines, TV Licences, business rates, etc.


So,

  • the more we become used to using the county courts (which the government do not wish us to do)
  • the more we use the county courts
  • the more pressure is placed on these governmental organisations
  • the less they can cope and hence,
  • force the government to CHANGE THE LAW!

If this happens it will mean rent arrears of only a few days can result in the tenant receiving a police escort from the property just like it is if a shop lifter fails to pay for their goods to Tesco or a shop keeper fails to pay their rent to a commercial landlord.  Your smart guy tenant will be in effect trespassing on your property – which is illegal!
