Pay Up Or…GET OUT (that’s my message to ALL my tenants – and to yours too!)These are the ONLY two options for my tenants. I provide a service for my customers (known as tenants in this case) and I give this service to my best of ability. My tenants get quiet enjoyment of MY properties that I have bought for them. I get paid for my service the day it is delivered i.e. the first day the rent is due. In most cases I get paid on or a few days after the due date but sometimes you meet a ……… smart guy. A smart guy that thinks they can live in your property for FREE. While YOU pay the mortgage on time (because you have to) and keep a roof over THEIR head, all they do is hide behind the law, because supposedly the law always favours the tenant, and they say explicitly or implicitly: “take me to court!” Well I’ve always got something to say to them: “No worries, you’ll be out of my place within 1 week AND I’ll take your deposit so I’ll be the one in credit” And “I will do this WITHOUT me having to write to you, confront you or speak to you” This usually happens with a 96% success rate. The other 4% of the time I do go to court and I win every time. Now can I ask you: Have you got a tenant that is living in your property but is point blank refusing to pay the rent? Are they more than 1 day late with their rent? Are you getting more and more stressed as the mortgage payments come out of your bank account on a timely basis but the rent comes in on an untimely basis? Do you get annoyed when some of your surplus cash, meant to be spent on yourself, is being used to meet the monthly mortgage payment because your smart guy tenant is not paying up? If you have a difficult tenant who is determined to stay then they will be escorted out by the police and court bailiffs within 12 weeks. If I did then my job would not just be full time it would be major time! I’ve got other things to do like buying more properties, socialising or sleeping! Unless you like spending your cash on irrelevancies like solicitors then you should NEVER get a solicitor involved. This is crap work for a solicitor as it is neither interesting for them nor financially rewarding for them even though it still costs YOU a lot of money. Solicitors struggle to justify their fee. While you chase a £500 debt and the solicitor charges you at least double that then it all becomes wholly uneconomicable. The more the court gets cluttered up with these trivial BUT valid cases the more the pressure there is to CHANGE THE LAW. It should never have to come to the county court if a tenant doesn’t pay the rent. For example - If you go shopping in Tesco, get to the checkout, decide not to pay and then leave without paying. Do you think Tesco is going to send you a county court summons? Hell No! You’ve just committed THEFT. You’ve STOLEN from a legitimate business organisation. The police will be called instantly, you’ll be arrested, convicted in the CROWN Court and potentially get prison. This is exactly what a smart arse tenant does. They steal from a legitimate business person (being you) with no punishment from the state. But do they get the same treatment as if they stole fromTesco? Certainly not! Its YOU who has to take the tenant to court at your own expense. Does the tenant face prison – No! All they get is an court order to leave the premises and a money judgement which they’ll never pay. The concept of court makes you think of solicitors, barristers, paperwork and pledges to the oath – which all sound expensive and foreign to us all. So in the end you abstain from going to court and let the problem become bigger and bigger or make you resort to unorthodox means for getting the tenant out. My aim is to make non payment of rent a CRIMINAL OFFENCE. Just like non payment of council tax, parking fines, TV Licences, business rates, etc. So,
If this happens it will mean rent arrears of only a few days can result in the tenant receiving a police escort from the property just like it is if a shop lifter fails to pay for their goods to Tesco or a shop keeper fails to pay their rent to a commercial landlord. Your smart guy tenant will be in effect trespassing on your property – which is illegal!
